Generally, an alien who marries a United States citizen and obtains his or her immigrant visa before the second wedding anniversary receives conditional permanent residency valid only for 2 years. Conditions of residence can be removed through a joint petition or by waiving the joint petition requirement.
A conditional resident must submit a joint petition (with their spouse) to remove the conditions of their residence before the period stipulated by immigration and expiration of their conditional residence. To this end, forms requested by the USCI will be used, and evidence that supports life in common from the moment of approval of conditional residency must be presented.
